The CJEU has established that the electricity distribution system operator changing the voltage level of electricity with a view to its distribution to the final customer must be regarded as a producer and will be liable for damage caused by a defect in its product.
The CJEU qualified an electricity distribution system operator as a producer, since it changes the voltage level of electricity with a view to its distribution to the final customer.
For this reason, the electricity distribution system operator is liable for damage caused by a defect in its product under the Council Directive of 25 July 1985 on the approximation of the laws, regulations and administrative provisions of the Member States concerning liability for defective products.
