According to a legislative proposal, the automatic suspension of the individual employment contract upon filling a position within an executive, legislative, or judicial authority could be limited to 5 years, with the aim of limiting the “blocking” of certain positions for an indefinite period.
According to the explanatory memorandum, if the term of office exceeds 5 years, the individual employment contract will no longer be considered suspended after the expiry of this period, but will terminate by operation of law if the civil servant/employee does not inform the employer in writing 5 business days before the end of the 5-year term of their option to return to their basic position (i.e., the one for which the contract was suspended).
This amendment is currently at the proposal stage and does not yet have any legal effect.
