If the construction works cannot be started or cannot be fully executed within the time limit initially set by the permit, the new Law no. 176/2022 provides the investor with a solution: an application for an extension of the construction permit.
The application must be lodged with the issuing authority at least 45 business days before the expiry of the permit.
In the original form of Law no. 50/1991, the extension of the building permit could be given for a maximum period of 12 months.
Furthermore, the application for an extension could be submitted at least 15 days before the expiry of the permit.
With the amendments made by Law no. 176/2022, these deadlines are modified. Firstly, the building permit may be extended for a period of 24 months and, secondly, the application for an extension must be submitted at least 45 days before the expiry of the permit.
The new legislation therefore allows for longer deadlines, thus offering support to investors, both in terms of having more time to build legally, and in terms of having a filing deadline that ensures the state authorities are operational. The fact that the application can be submitted at least 45 days before the expiry of the permit means that investors will not be subject to the risk of temporarily halting work until the authorities respond.
