The amendment introduced by Government Emergency Ordinance no. 29/2026 aims to repeal, as of 1 July 2026, Article LXX of Government Emergency Ordinance no. 156/2024, which allowed for the maintenance of a derogatory regime from Article 164(1) (1) of the Labor Code regarding the guaranteed national minimum gross base salary. With the entry into force of Government Decision no. 146/2026, which sets the minimum salary at RON 4,325 RON/month, employers in both the public and private sectors will be required to apply a single minimum salary regime, without the possibility of invoking the previous derogation. The Government justified the repeal by citing the need to eliminate discrimination between different categories of employees and to ensure a coherent regulatory framework, in accordance with the constitutional principles of legality, non-discrimination, and equal rights.
