According to a press statement published by the National Authority for the Supervision of Personal Data Processing (“ANSPDCP”), the National Authority for Consumer Protection (“ANPC”) was sanctioned with a warning for processing personal data of individuals without legal basis. The data processed by the ANPC was collected by means of Body Camera devices, used by ANPC inspectors during their controls.
In this regard, ANSPDCP stated that inspectors recorded without any agreement and without any supervision, not only colleagues, employees or representatives of economic operators, but also a lot of private individuals.
The data processing was carried out for the purpose of pre-constitution of evidence, but ANPC could not prove that this processing was necessary for the performance of a public task or a legal obligation. At the same time, ANPC was obliged to stop processing the data and to delete all data collected.
