The directive clarifying the functioning of European Works Councils has been published in the Official Journal of the European Union

Directive (EU) 2025/2450 amends Directive 2009/38/EC, introducing a number of clarifications and enhancements to the legal framework applicable to European Works Councils (EWCs), including: (i) extending the rights of workers and European Works Councils; (ii) increasing the costs borne by employers, including those relating to the financing of EWC experts (including legal experts), training, and other expenses; and (iii) expanding the scope and content of management’s obligations regarding the information and consultation of EWCs.

The transposition timetable provides for the adoption of national rules by 1 January 2028, which will be applicable from 2 January 2029, with transitional provisions for adapting existing agreements and for notifying the European Commission of access to procedures.
