Our colleagues in the Litigation and Arbitration department (Cătălin Alexandru, Carmen Calabache and Irina Suătean) have managed to successfully defend before the Bucharest Court of Appeal an arbitral award granting over EUR 90 million to our client, a leading international infrastructure contractor.
The initial dispute arose from the performance of FIDIC agreements concluded between our client and the National Railway Company “CFR” in relation to the rehabilitation of railway lines. After an arbitration conducted before the International Chamber of Commerce (ICC), CFR was ordered by the arbitral tribunal to pay over EUR 90 million for works executed by our client under the agreements.
CFR filed an annulment claim against the arbitral award, asking the Bucharest Court of Appeal to annul the award. On 8 June 2021, the Bucharest Court of Appeal dismissed CFR’s annulment claim in its entirety.
The Filip & Company team assisted the client both in the arbitration proceedings (together with Corbett & Co), as well as in the subsequent annulment claim related trial. Both proceedings entailed complex administrative, civil, and commercial law issues, the stake of the dispute being of utter importance for the client.
