A legislative proposal registered with the Senate seeks to amend and supplement Law no. 448/2006 on the protection and promotion of the rights of persons with disabilities, with a view to clarifying the concept of “full-time equivalent” (FTE) and standardizing the method of calculating the mandatory quota for the employment of persons with disabilities for all employers.
According to the proposal, FTE is defined as a standard reference corresponding to an 8-hour working day and a 40-hour working week, and this indicator will be used uniformly to determine the number of employees. The obligation to comply with the employment quota will apply to public authorities and institutions, as well as to public or private legal entities with at least 50 employees, calculated in FTE. In this context, the employers concerned will be required to ensure a minimum quota of 4% of persons with disabilities, relative to the total number of employees, expressed in FTE.
