On Friday, 24 July 2020, Emergency Ordinance no. 120/2020 on the implementation of support measures towards employees and employers, establishing some measures in the field of social protection in the context of the epidemiological situation caused by the spread of SARS-CoV-2 virus, came into force.
Changes to technical unemployment benefits
Through the means of this new emergency ordinance, the state ensures the granting of the technical unemployment benefits (provided by the Emergency Ordinance no. 30/2020) to the employers whose activity has been suspended as a result of the epidemiological investigation carried out by territorial public health institutions. It is to be noted that the granting of this indemnity has been extended for after the expiration of the state of emergency by Law no. 55/2020, art. 24.
Applicability and methodology
In practice, the employers who find themselves in this situation will now be able to request the settlement of the technical unemployment benefits for their employees under the conditions and according to the procedure established by Emergency Ordinance no. 30/2020.
The technical unemployment benefits are calculated and granted for the number of days during which the activity was suspended. Employees on medical leave who receive the related social insurance benefits do not gain from this measure.
This measure is applicable for the entire period during which activity was suspended, but no later than 31 December 2020.
